Senate’s amendments to the amendment to the Spatial Planning Act

Yesterday, i.e. on June 22, 2023, the plenary session of the Senate adopted the Act amending the Spatial Planning and Development Act and certain other acts (Senate Paper No. 992) with 39 amendments. The amendments recommended for adoption are available in the Senate paper 992 Z.

As part of the adopted amendments, the deadline for the expiry of the decision on development conditions (decyzje “WZ”) was shortened from 5 to 2 years from the date of entry into force. It was also possible to extend its validity by another 2 years, if the conditions specified in the decision on development conditions are consistent with the general plan. In addition, a change was introduced as part of the transitional provisions, according to which the expiry date of the development conditions decision will also apply to those decisions that became final before the date of entry into force of the amendment. Pursuant to the previous version of the amendment, this period did not apply at all to decisions owhich were valid on the date of entry into force of the amending act.

In addition, the validity period of the study of conditions and directions of spatial development of communes was extended from 31 December 2025 to 31 December 2028.

The provisions on the application of the procedure for adopting integrated investment plans in the case of wind farms have also been clarified.

Now the Senate’s amendments will be voted on in the Sejm. The next sitting of the Sejm will be held on 6 and 7 July 2023.
