System support for the implementation of the National Reduction Target, which is the amendment to the Act on the fuel quality monitoring and scrutinizing system, enters into force

The second amendment to the act on the fuel quality monitoring and scrutinizing system in this year introduces changes to ensure the implementation of the National Reduction Target, i.e. the obligation to reduce the emission of greenhouse gases, liquid fuels, liquid biofuels, liquefied gas, compressed and liquefied natural gas or oil for marine engines. inland waterways, used in transport, and electricity used in motor vehicles.

The most important changes for entrepreneurs introduced by the amendment include:

  • simplifying the conditions for joint implementation of NCR by several entities by resigning from prior notification of the intention to do so. The entrepreneur will have to include this information separately in the annual report. Additionally, the deadline for the fulfillment of the reporting obligation was extended until June 30;
  • correction of the formula for calculating the fine for failure to implement NCR. The previous symbol from the “S” formula has been given a fixed value – PLN 215 per ton of carbon dioxide equivalent;
  • making the possibility of using electricity more realistic by introducing an annual update of the electricity benchmark;
  • introducing the possibility of using compressed natural gas and liquefied natural gas used in transport by including in the NCR implementation of entrepreneurs placing CNG or LNG on the market at a fuel station or company station;
  • the possibility of partial compensation of the NCR obligation with a replacement fee for entities that did not meet it in 2021-2024.

The President of the Energy Regulatory Office will be responsible for the register of greenhouse gas emission reduction projects in the mining segment introduced by the legislator.

The records available in the ERO’s public information bulletin will provide entities implementing NCR with information on greenhouse gas emission reduction projects and emission limitations achieved from these projects. The purpose of the entry in the register is to inform other market participants that a given reduction has already been used. The condition for voluntary entry in the register will be the provision of complete information about the project and possession of a legal title to dispose of the reduction resulting from the project.
