Sejm on Thursday, April 15 this year, adopted a draft act amending the Energy Law and certain other acts, which provides, inter alia, creating a central information system for the energy market, introduces the assembly schedule of the so-called smart meters and provides for the extension of the auction system for renewable energy sources by the end of this year.
MPs supported two amendments to the amendment, including one to the offshore act, enabling the so-called rolling guarantees in the case of companies producing energy from offshore wind farms. As explained during the committee meeting, the changes will “make the obligation to provide security more flexible by enabling the so-called rolling over of the guarantee and changing the form of the security during the period required by the act”.
The Ministry of Climate and Environment added that this change will facilitate investments in offshore wind farms.
The second amendment, which was supported, deletes from the act the delegation to issue a regulation specifying the rules protecting against profiling of natural persons with the use of measurement data obtained from the central energy market information system. As explained, the rules for the protection of personal data are set out in other legal provisions, including the GDPR, and profiling will not be allowed.
