On February 25, 2020, comments on the bill on the promotion of electricity generation in offshore wind farms were published on the website of the Government Legislation Center.
According to the draft, there is no requirement to apply Public Procurement Law to building wind farms in the Polish Baltic Sea zone. Such a provision (Article 70 of the draft) raises doubts of the Public Procurement Office, which indicates a potential non-compliance with national and EU law.

Additionally, concerns regarding the inclusion in offshore investments of information on so-called local content were raised. According to the development ministry, it is a kind of “off-set” and such proposals may lead to the initiation of infringement proceedings by the European Commission.
