ERO: rules for extending the deadlines for meeting obligations in the auction system and FIT / FIP systems

The Energy Regulatory Office published a communiqué in which it reminds of the possibility of extending the deadlines related to the commencement of the production or sale of electricity both in the auction system and in the guaranteed tariff system (FIT: feed-in-tariff) and the market price subsidy system (FIP: feed -in premium).

The application may be submitted if it occurs during the implementation of the so-called new installations of a renewable energy source, circumstances specified in the RES Act, i.e. delays:

  1. regarding the supply of equipment included in the renewable energy source installation,
  2. regarding the supply of elements necessary for the construction of the renewable energy source installation,
  3. in the implementation of the renewable energy source installation and connection to the power grid,
  4. during the commissioning or commissioning of the renewable energy installation,
  5. when obtaining a license or entry into the registers specified in the Act,

caused by the state of epidemic threat or state of epidemic announced by way of ordinance of the Minister of Health.

This period may be extended by the period indicated by the manufacturer in the application, but not longer than by 12 months from the date on which the deadline for the implementation of these obligations would expire. In the application, the manufacturer must provide, among others a statement by itself or the suppliers of devices included in the RES installation confirming that the delay in the delivery of equipment or commissioning of the installation is due to the above-mentioned circumstances.
