On April 25, 2023, the Council of Ministers adopted a draft act amending the act on renewable energy sources and certain other acts (list number RCL UC99), submitted by the Minister of Climate and Environment. The draft act in the version adopted by the Council of Ministers has not yet been published.
The draft includes, among others: the following changes:
- Extending the guarantee of origin system with new energy carriers: heat and cold energy and gas from renewable energy sources; provisions are also introduced enabling the Energy Regulatory Office to join the Association of Issuing Bodies, an association of bodies issuing guarantees of origin.
- Increasing auction volumes for offshore wind farms from 5 to 12 GW in 2025-2031.

- A National RES Contact Point for investors will be established.
- Producers of biomethane from biogas or agricultural biogas will be able to run a business in this respect and benefit from the support system specified in the Act.
- Improvements will be introduced for energy clusters, i.e. agreements between locally operating entities that organize themselves to produce, distribute and store electricity for their own needs for the benefit of their community members.
- The provisions on the priority of purchasing heat from renewable sources and waste thermal treatment installations, as well as waste heat, will be clarified.
