In February last year, Poland violated EU law by exceeding the PM10 (particulate matter) concentration standard several times. No adequate measures have been taken under the air protection programme and there has been a lack of adequate adaptation of Directive 2008/50/EC on air quality and cleaner air in Europe, as alleged by the Court of Justice of the European Union.
The European Commission is concerned that in previous years, daily airborne particulate matter concentration standards have been exceeded in 35 zones out of 46 possible. Nine of them exceeded the annual standards.
In response to the allegations, the EU Court of Justice created an amendment to the Environmental Law Act. This document recasts the legislation and obliges to limit the value of permissible exceedances in the shortest possible time.
