On February 8, 2023, the Sejm adopted some of the amendments submitted by the Senate to the urgent government draft act amending the act on special solutions in the field of certain heat sources in connection with the situation on the fuel market and some other acts (Sejm Paper No. 2973). The act has been submitted for signature by the President (the deadline for signing urgent acts by the President is 7 days).
Article 10 of the Act contains amendments to the Act of October 27, 2022 on emergency measures aimed at limiting electricity prices and supporting certain customers in 2023, concerning, among others, the definition of an electricity sales contract and the method of calculating the market price, in accordance with which should include all additional cash settlements of producers resulting from the provisions of concluded electricity sales contracts or other contracts in which additional cash settlements depend on the amount or value of electricity sold. The adopted amendments of the Senate do not interfere with the substantive content of the changes regarding the price limit mechanism.
Pursuant to the transitional provision to Art. 10, changes to the method of calculating the market selling price under the price limit mechanism shall enter into force on the first day of the following month after a month of announcements, i.e. they will most likely apply from the beginning of March this year.
