The Commission is still analyzing the Polish regulations governing offshore construction

According to the biznesalert.pl portal, the former prime minister and president of the European Parliament and current MEP, prof. Jerzy Buzek (Platforma Obywatelska / European People’s Party) asked the European Commission whether the Polish regulations on issuing permits for the construction of offshore wind farms comply with EU law. The European Commissioner for Energy, Kadri Simson, replied that the Commission had not yet completed its analysis of the Polish regulations.

– In connection with my previous question requiring a written answer (P-004410/2021 of September 28, 2021), I would like to ask the Commission about the current status of the analysis of compliance of the draft Polish act on assessment criteria in the procedure for granting permits for the construction of offshore wind farms in Poland with EU state aid and energy rules. In connection with Russia’s war against Ukraine and its consequences, this is a matter of the utmost importance. Both Poland and the EU must accelerate the implementation of renewable energy sources in order to efficiently become independent from supplies of fossil fuels from Russia, which was emphasized in the Commission communication of March 8, 2022 entitled “REPowerEU: Affordable, Secure and Sustainable Energy for Europe” (COM (2022) 0108). The selection of entities investing in offshore wind energy in Poland, based on the regulation of November 2021, is already at an advanced stage, and there is still no clarity as to the effects of the Commission’s legal analysis regarding this procedure.
