MFA objections to the amendment of the Energy Law Act

The website of the Government Legislation Center has published the remarks of the Ministry of Foreign Affairs on the draft amendment prepared by the Ministry of Energy in the Energy Law (UC34), after which the decisive role in appointing the President of the Energy Regulatory Office would be attributed to the Minister of Energy.

MFA, referring to the content of EU directives: 2009/72 / EC on common rules for the internal electricity market and Directive 2009/73 / EC on common rules for the internal market in natural gas, states that the draft provisions are in conflict with EU legislation, according to which Member States should ensure that “a regulatory body can take independent decisions, independently of any political entity, and have separate budgetary resources and autonomy in the implementation of the allocated budget each year and adequate human and financial resources to perform their duties”.
