SEO comments on the RES Act in connection with a pandemic

The Renewable Energy Association, following the changes provided for in the Act of 31 March 2020 on special solutions related to the prevention, prevention and eradication of COVID-19, other infectious diseases and the resulting crisis situations and some other acts regarding the Act of 20 on renewable energy sources in February 2015, presented a legislative proposal specifying and extending the solutions included in it.

Most of the proposed changes are a consequence of the modifications introduced under the last amendment and allow for comprehensive addressing of the issue of extending the deadline for meeting the auction participant’s obligation to sell electricity for the first time under the auction system and the maximum age of devices included in a given installation. Similar modifications have been proposed for producers using feed-in tariff (FiT) and premium feed-in (FiP) systems.

However, bearing in mind the crisis situation caused by the COVID-19 pandemic and the changes aimed at protecting interests in progress, we have presented a postulate that projects under construction or planned for construction outside the auction system should also be secured – especially with regard to the term of the grid connection agreement.

It should be emphasized that projects that are being prepared for implementation based on Power Purchase Agreements (PPA) or in another formula are also threatened by delays at the level of administrative procedures and implementation contracts. Market participants point to disruptions in the supply chain and suppliers citing force majeure. The risk of delays in the planned development of this type of projects should therefore be seen as high.
