Amendments to the RES Act came into force

March 31, 2020 the Act of March 31, 2020 amending the Act on special solutions related to the prevention, prevention and eradication of COVID-19, other infectious diseases and crisis situations caused by them as well as some other acts, entered into force, providing, inter alia, changes in the scope of the Act on renewable energy sources (Dziennik Ustaw 2020 r. poz. 568).

As we informed earlier, the provisions in force introduce the possibility of extending the deadline for meeting the auction participant’s obligation to sell electricity for the first time under the auction system and the maximum age of devices included in a given installation as a result of circumstances beyond the control of the Manufacturer, taking into account the situation of an epidemic threat, an epidemic or a state of danger of spreading an infection or an infectious disease that may pose a threat to public health, in particular the occurrence of a particularly dangerous or highly contagious disease referred to in the provisions on the prevention and combating of infections and infectious diseases in humans, including those caused by viral infections SARS-CoV-2.

A similar regulation has been proposed for Manufacturers using the feed-in tariff (FiT) and feed-in premium (FiP) systems.

The transitional provision of the Amendment Act provides the opportunity to extend the deadline for meeting the obligation of the auction participant to sell electricity for the first time under the auction system by manufacturers whose offers have won the auction in previous years. Similarly, the transitional provision covers small and medium-sized Manufacturers using FiT and FiP systems.
