Act on offshore in the work list of the Council of Ministers

December 20 this year the bill on the promotion of electricity generation in offshore wind farms was included in the list of legislative and program works of the Council of Ministers.

According to published information, the Government plans to adopt the law in the first quarter of 2020. The person responsible for developing the project is the Minister of State Assets Jacek Sasin, the body responsible for submitting it to the Ministry of State Assets.

The essence of the solutions included in the project:

The recommended solution for the rapid development of the offshore wind energy sector, and thus mitigating the risk of the generation gap remaining and maintaining and enabling compliance with EU renewable energy goals, is to introduce a separate support system dedicated to this technology, tailored to its technical conditions and economic, as well as introducing a number of improvements in administrative procedures for issuing decisions necessary for the implementation of projects. At the same time, it is not appropriate to repeat the regulations of acts setting out the legal framework for maritime spatial development, environmental issues and the construction process – in this respect it is only proposed to introduce point exceptions to the application of the provisions of the relevant acts, without any major system interference. The support system will be financed from the existing RES fee (referred to in Article 95 of the RES Act), which already includes the expenditure related to support potentially granted to offshore wind farms, therefore its introduction will not increase the burden on end users.
